U.S. Government and the LCHR File Briefs on Whether the Supreme Court Should Consider the Alien Tort Claims Act

The Supreme Court is currently considering whether to grant certiorari in Sosa v. Alvarez-Machain.  One of the main issues presented is whether the Alien Tort Claims Act creates a cause of action or is merely a jurisdictional statute.  The U.S. government has filed a brief urging the Supreme Court to take the case.  The Lawyers Committee and the Rutherford Institute have filed an amicus brief arguing against certiorari.  Both briefs are available in the Library under ATCA/Briefs.
