Virginia Court Bars Death Penalty Following Violation of Rights to Consular Notification

In this decision, the Circuit Court of Fairfax County granted a pre-trial motion to prohibit the death penalty based on violation of the defendants rights to consular notification. The court writes, the "Vienna Convention does confer judicially enforceable rights [and] preclusion of the death penalty is an appropriate remedy." Click the link for access to a PDF of the decision.
